Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of the website [www.sinacrisps.com](https://www.sinacrisps.com) (the "Website") and the purchase of products from Sina Crisps Ltd ("we", "us", or "our"). By accessing the Website, placing an order, or subscribing to our services, you agree to be bound by these Terms. If you do not agree, please do not use the Website or make any purchases. These Terms incorporate our [Privacy Policy](https://sinacrisps.com/policies/privacy-policy) and [Cookie Policy](https://sinacrisps.com/policies/cookies), which provide additional information on how we handle your data.

  1. Company Information Sina Crisps Ltd is a company registered in Jersey under company number 160932. Our registered office is at 167–169 Great Portland Street, London, W1W 5PF. Our VAT number is 499 3070 51. We are the food business operator responsible for the products sold on the Website. If you have any questions, please contact us at hello@sinacrisps.com.

  2.  Definitions - **Consumer**: An individual acting for purposes outside their trade, business, craft, or profession. - **Product(s)**: Packs of crisps sold in sizes of 6, 12, or 24 units. - **Subscription**: A repeat order service where Products are delivered at regular intervals (e.g., monthly) until cancelled. - **Order**: A single purchase or the initial commitment to a Subscription.

  3.  Use of the Website You may use the Website for lawful purposes only. You must not: - Use the Website in any way that causes damage or disrupts its functionality. - Transmit any harmful software, viruses, or engage in unauthorized access. - Use the Website for commercial purposes without our written consent. - Violate any applicable laws, including UK consumer protection laws. We reserve the right to suspend or terminate your access if you breach these Terms.

  4. Account Registration To place an Order or start a Subscription, you must create an account. You agree to provide accurate information and keep your login details secure. You are responsible for all activities under your account. We may suspend or close your account if we suspect misuse.

  5.  Orders and Contract Formation All Orders are subject to acceptance by us. Upon submitting an Order via the Website (powered by Shopify), you receive an email confirmation. This confirmation does not form a contract until we dispatch the Products (or, for Subscriptions, the first delivery). Before completing an Order, we will provide: - A clear description of the Products, including pack sizes (6/12/24 units). - The total price, including VAT, delivery charges, and any applicable taxes. - Delivery details and estimated times. - Information on your right to cancel. Prices are in GBP and include VAT. We reserve the right to correct pricing errors. For food Products, before purchase, we provide: - Full ingredients lists. - Allergen information for the 14 regulated allergens (celery, cereals containing gluten, crustaceans, eggs, fish, lupin, milk, molluscs, mustard, peanuts, sesame, soybeans, sulphur dioxide/sulphites (>10ppm), tree nuts), emphasised in bold. - Net quantity, "use by" dates (where applicable), and storage instructions. - Any warnings (e.g., "may contain traces" if cross-contamination risks exist). This information complies with the Food Information Regulations 2014 and Food Safety Act 1990. At delivery, allergen details will be included on packaging or an enclosed sheet.

  6. Subscriptions Our Subscriptions allow repeat deliveries of Product packs at intervals you select (e.g., every 30 days). Key terms: - **Auto-Renewal**: Subscriptions renew automatically until cancelled. We will send a reminder email 3-6 business days before each renewal, including the upcoming charge and easy cancellation instructions, in line with the Digital Markets, Competition and Consumers Act 2024 (effective April 6, 2025). - **Pricing**: The price for each delivery is fixed at Order unless we notify you of changes (e.g., due to cost increases) at least 14 days in advance. You may cancel if you disagree. - **Minimum Term**: You must receive at least two deliveries over the timeline you have chosen. If you cancel before the second delivery is dispatched, a cancellation fee equal to the cost of the second delivery (including delivery charges) will be charged. - **Cancellation**: You may cancel anytime via your account dashboard (one-click option) or by contacting us at hello@sinacrisps.com. Cancellations take effect at the end of the current billing period. For the initial cooling-off period, see Section 10. - **Changes**: You can update delivery address, frequency, or pack size via your account, subject to availability. - **Failed Payments**: If payment fails, we will retry once; further failures may pause deliveries until resolved. Subscriptions are governed by these Terms and UK consumer law, including enhanced protections under the DMCC Act for clear terms, no hidden fees, and straightforward cancellations.

  7.  Payment Payments are processed securely via Shopify Payments or selected gateways (e.g., credit/debit cards, PayPal). You authorize us to charge your payment method for the Order total, including Subscriptions. We do not store full payment details; this is handled by our third-party providers.

  8. Delivery We aim to deliver within 4 working days after dispatch via Royal Mail 48hr Tracked. Delivery is to UK mainland and Channel Islands only. Risk of loss passes to you on delivery. If no one is available to sign, the carrier may leave it in a safe place or reattempt delivery. Check Products immediately on receipt; notify us within 48 hours of any damage. Delays due to strikes, weather, or unforeseen events are beyond our control, but we will keep you informed.

  9. Product Quality and Compliance All Products comply with UK food safety standards, including the Consumer Rights Act 2015 (goods must be of satisfactory quality, fit for purpose, and as described). If Products are faulty, damaged, or not as described, contact us within 30 days for replacement or refund. We cover return costs in such cases. For allergens: We train staff on handling and labelling. If cross-contamination cannot be avoided, we state this clearly (e.g., "Made in a facility that handles nuts"). Always consult product labels and our Website for the latest information.

  10. Returns, Refunds, and Cancellations ### Right to Cancel (Cooling-Off Period) Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have 14 days from receipt to cancel an Order or Subscription (for undelivered goods) without reason. For delivered goods, notify us within 14 days and return within 14 days after notification. To cancel: - Log into your account or email returns@sinacrisps.com. - Provide Order details and reason (optional). You pay return shipping unless the Products are faulty, misdescribed, or we sent the wrong item. Refunds (excluding original delivery) are processed within 14 days of receiving returned goods. Exceptions (no right to cancel): - Perishable goods (e.g., crisps nearing "use by" date) if returned after deterioration. - Personalized or custom Products. - Sealed hygiene items once opened. ### Faulty Goods Under the Consumer Rights Act 2015, you have 30 days for full refund on faulty goods; up to 6 months for repair/replacement; and 6 years for other remedies. Contact us promptly. ### Subscription Cancellations See Section 6. Prorated refunds apply for unused periods post-cancellation, subject to the minimum term and cancellation fee.

  11.  Limitation of Liability To the extent permitted by law, our liability for losses arising from your use of the Website or Products is limited to the price paid for the relevant Order. We are not liable for: - Loss of profits, business, or indirect losses. - Allergenic reactions if you ignored labelling/warnings. - Delays beyond our control (e.g., force majeure). Nothing excludes liability for death, personal injury from negligence, fraud, or breaches of consumer rights.

  12. Intellectual Property All Website content (text, images, logos) is owned by us or licensed to us. You may not reproduce it without permission, except for personal use.

  13. Privacy and Data Protection We process your data in accordance with our Privacy Policy and the UK GDPR. For Subscriptions, we use data for order fulfillment, reminders, and marketing (with consent).

  14. Governing Law and Jurisdiction These Terms are governed by the laws of England and Wales. Disputes will be subject to the non-exclusive jurisdiction of the courts of England and Wales. As a Consumer, you may also use courts in your country of residence (Scotland, Northern Ireland, or Channel Islands if applicable).

  15. Changes to These Terms We may update these Terms; changes will be posted on the Website with the "Last Updated" date. Continued use constitutes
    acceptance. For material changes to Subscriptions, we will notify you in advance.
